ClassTutor Terms of Service

1. Parties

This agreement is between:

and the parent/guardian named in the enrolment form.

By making payment through a Stripe payment link, setting up automatic payment, or allowing the student to attend lessons, the parent/guardian agrees to these Terms of Service.

2. Services Provided

ClassTutor provides online tuition services, including group tuition, 1-to-1 tuition, homework, assessments, learning resources, lesson recordings and access to the Student Portal where applicable.

The exact subjects, lesson frequency, lesson type, teacher allocation, fees and start date will be confirmed separately by ClassTutor.

ClassTutor will use reasonable care and skill in providing tuition services.

3. Student Responsibilities

The student agrees to:

  • attend lessons on time;
  • behave politely and respectfully towards teachers, staff and students;
  • attend lessons from a suitable quiet space, preferably at a desk;
  • have a working camera, microphone and internet connection;
  • keep their camera on unless otherwise agreed;
  • focus during lessons and avoid distractions;
  • complete homework, assessments and classwork on time;
  • communicate with teachers or ClassTutor if they are struggling;
  • keep lesson links, recordings, resources and portal access private;
  • not share ClassTutor resources with anyone outside their household.

ClassTutor may remove or suspend a student from lessons where behaviour is disruptive, unsafe, abusive, inappropriate or repeatedly below the expected standard.

4. Parent/Guardian Responsibilities

The parent/guardian agrees to:

  • ensure the student attends lessons regularly and on time;
  • ensure the student has suitable equipment and internet access;
  • remain contactable during online lessons;
  • support the student in catching up on missed work;
  • inform ClassTutor of relevant educational needs, safeguarding concerns or access requirements;
  • share relevant school feedback, grades or reports where possible;
  • ensure all payments are made on time;
  • communicate with ClassTutor through official channels.

The parent/guardian remains responsible for the student’s safety, welfare and supervision while the student attends online lessons from home.

5. Online Lessons, Cameras and Recordings

Lessons may be recorded for safeguarding, quality assurance, training, dispute resolution and student catch-up purposes.

By agreeing to these terms, the parent/guardian consents to the student attending online lessons where their name, voice and camera image may be visible to teachers and, in group lessons, other students.

Lesson recordings may be made available through the Student Portal to students in the same class. Recordings must not be downloaded, copied, shared, posted online or used for any purpose outside ClassTutor tuition.

Call recordings may also be used for training, monitoring, quality assurance and dispute resolution.

ClassTutor will process personal data in accordance with applicable UK data protection law. Further details are set out in ClassTutor’s Privacy Policy, which is available on request or on ClassTutor’s website.

6. Fees and Automatic Monthly Payments

Tuition fees are payable monthly in advance.

The monthly fee is calculated using the following formula unless otherwise agreed:

4.5 weeks × agreed hourly/lesson rate × number of lessons per week

The parent/guardian acknowledges that this is a monthly subscription-style fee. The number of lessons delivered in a calendar month may vary depending on how many lesson days fall in that month.

Payment must be made by automatic recurring payment, including card subscription, direct debit or another automatic payment method approved by ClassTutor.

ClassTutor does not normally accept manual bank transfer as the regular payment method.

By completing payment setup, the parent/guardian authorises ClassTutor to collect recurring monthly payments until the agreement is cancelled in accordance with these terms.

7. Failed Payments and Non-Payment

If a payment is late, failed, reversed, cancelled or disputed, ClassTutor may:

  • contact the parent/guardian to arrange payment;
  • retry the automatic payment method to any card held on record;
  • charge a failed payment processing fee of up to 3% of the failed payment amount, where reasonably incurred;
  • suspend lessons or portal access;
  • withhold further tuition until payment is made;
  • recover outstanding fees;
  • cancel the student’s place.

The failed payment processing fee is intended to cover the administrative, payment processing and operational costs caused by failed, reversed or disputed payments.

Suspension due to non-payment does not automatically cancel the agreement or remove any outstanding fees already due.

8. Cooling-Off Rights and Immediate Start

Where this agreement is entered into online, by phone or away from ClassTutor’s premises, the parent/guardian may have a 14-day cooling-off period under the Consumer Contracts Regulations 2013.

However, the parent/guardian acknowledges that ClassTutor tuition is a personalised and scheduled educational service, arranged around the student’s subject, year group, teacher availability, class placement and learning needs.

If the parent/guardian asks ClassTutor to begin tuition within the 14-day cooling-off period, the parent/guardian expressly agrees that:

  • ClassTutor may begin providing services immediately;
  • ClassTutor may allocate a teacher, reserve a student place, prepare lessons and provide access to resources;
  • the parent/guardian must pay for any services already provided before cancellation;
  • any refund, if legally due, may be reduced to reflect lessons delivered, access provided, teacher time reserved, administrative work completed and resources made available.

Where tuition has begun during the 14-day cooling-off period and the parent/guardian later cancels, ClassTutor may deduct a proportionate amount for services already supplied before cancellation.

This may include:

  • the full value of any lesson already delivered;
  • up to the full value of any lesson due to take place within 7 days of cancellation, where tutor time, class space or lesson preparation has already been reserved and cannot reasonably be reallocated;
  • reasonable administration, onboarding, scheduling and resource access costs already incurred.

ClassTutor will not charge for tutor time that has not been used or genuinely reserved, or where the cost can reasonably be avoided.

If the tuition package or agreed service has been fully performed within the 14-day period following the parent/guardian’s express request, the right to cancel may be lost.

If the parent/guardian does not want tuition to begin during the 14-day cooling-off period, they must inform ClassTutor in writing before lessons are arranged.

9. Cancellation by Parent/Guardian

The parent/guardian may cancel tuition by completing the cancellation form at www.classtutor.co.uk/cancel. Cancellation will only be processed once the form has been submitted.

Cancellation takes effect after a one-month paid notice period, starting from the date the cancellation form is submitted. Tuition fees remain payable during the notice period, and the student may continue attending lessons during that period.

This one-month paid notice period reflects the ongoing monthly tuition arrangement and allows ClassTutor to manage teacher commitments, class planning, reserved student places, administration, scheduling and operational costs.

During the notice period:

  • fees remain payable;
  • the student may continue attending lessons;
  • unused credits are not redeemed until after the notice period;
  • the notice period is not reduced by holidays, missed lessons, pauses, unused credits or non-attendance.

10. Continuing Tuition, Year Progression and Summer Lessons

Tuition is provided on an ongoing monthly basis and will continue until:

  • the parent/guardian cancels in accordance with these terms;
  • ClassTutor ends the tuition arrangement;
  • the student completes their GCSE or A-level exams; or
  • both parties agree otherwise in writing.

The parent/guardian may cancel tuition at any time by following the cancellation process in these terms, subject to the one-month paid notice period.

Unless the parent/guardian cancels, tuition will continue automatically from one academic year to the next, including progression from one year group to the next. This is to allow continuity of learning, teacher planning and class placement.

Lessons also continue during summer periods unless the parent/guardian requests a pause or cancellation in accordance with these terms.

During summer periods, ClassTutor may offer daytime lesson slots instead of evening slots. ClassTutor will give reasonable notice of any summer timetable changes and will try to provide suitable lesson times where reasonably possible. Lessons will normally return to evening slots after the school term begins again, subject to timetable, class and teacher availability.

11. Pausing Lessons

If the parent/guardian wishes to pause lessons for holidays, summer periods or other planned absences, they must contact ClassTutor at least 2 weeks before the pause is due to begin.

Pausing lessons is subject to ClassTutor approval and availability.

A pause does not cancel tuition and does not replace, reduce or run alongside the one-month paid notice period.

If a pause is for more than 2 weeks, ClassTutor may require the parent/guardian to pay one month of tuition fees in advance before the pause begins. This advance payment secures the student’s place and will be applied to tuition after the pause ends.

12. Credits and Overpayments

Where ClassTutor agrees that a credit is due, the credit will be added to the student’s account.

Credits may be used towards:

  • future lessons for the same student;
  • lessons for a sibling;
  • lessons for another family member approved by ClassTutor.

Credits may also be redeemed at the end of the academic year, subject to ClassTutor’s reasonable discretion.

If the parent/guardian cancels tuition, any valid lesson credits will be applied or settled after the one-month paid notice period has been completed.

Credits have no cash value unless ClassTutor expressly agrees otherwise.

13. Lessons Cancelled by ClassTutor

If ClassTutor cancels a lesson, ClassTutor will either:

  • arrange a replacement lesson;
  • provide a suitable catch-up option;
  • add a credit to the student’s account; or
  • provide another reasonable alternative.

ClassTutor is not responsible for cancellations caused by events outside its reasonable control, including teacher illness, internet/platform failure, emergency closure or force majeure events.

14. 1-to-1 Lesson Rescheduling

For 1-to-1 lessons, the parent/guardian may request to reschedule a lesson by giving at least 48 hours’ notice.

Rescheduling is subject to teacher availability and must be agreed by ClassTutor.

If less than 48 hours’ notice is given, ClassTutor is not required to reschedule the lesson, and the lesson may be charged as normal.

If the student fails to attend a scheduled 1-to-1 lesson, the lesson is charged as normal and no refund is due.

15. Group Lesson Absence

Group lessons continue whether or not an individual student attends.

If a student misses a group lesson, no refund is due. The student should catch up using the Student Portal, lesson recording, homework or other resources provided.

For planned leave, the parent/guardian should contact ClassTutor at least 2 weeks in advance. ClassTutor may, at its discretion, add lesson credits to the account.

Sudden absence, late notice absence and non-attendance are charged as normal.

16. Homework, Assessments and Progress

ClassTutor may provide homework, assessments and feedback to support student progress.

The parent/guardian understands that student progress depends on attendance, effort, homework completion, parental support and regular communication.

ClassTutor does not guarantee any specific grade, exam result, school outcome or academic improvement.

17. Tutor Non-Solicitation

The parent/guardian and student must not privately approach, engage, employ, contract with or receive tuition from any ClassTutor tutor outside ClassTutor without ClassTutor’s written agreement.

This restriction applies during tuition and for 12 months after the student’s final lesson.

If this clause is breached, ClassTutor reserves the right to recover its reasonable losses, including lost fees and recruitment/administrative costs.

18. Intellectual Property

All ClassTutor materials, including worksheets, recordings, slides, lesson links, homework, assessments, portal content and teaching resources, remain the property of ClassTutor or its licensors.

They are provided for the student’s personal educational use only.

They must not be copied, shared, sold, uploaded, distributed or used for any commercial purpose.

19. Marketing Consent

ClassTutor may ask for consent to use student achievements, testimonials, classroom footage, images or videos for marketing.

This will be handled separately through marketing consent options.

The parent/guardian may choose:

General content, such as classroom footage:

Consent may be withdrawn at any time by contacting ClassTutor.

20. Safeguarding

ClassTutor takes safeguarding seriously and expects all students, parents, tutors and staff to behave appropriately.

Any safeguarding concern should be reported to ClassTutor immediately.

ClassTutor may take reasonable action where safeguarding concerns arise, including contacting the parent/guardian, pausing lessons, removing a student from a class, or making external referrals where legally required.

21. Complaints and Disputes

If the parent/guardian has a complaint, they should contact:

ClassTutor will aim to respond within 24 hours where possible, although complex complaints may take longer.

The parent/guardian agrees to raise concerns promptly so ClassTutor has a reasonable opportunity to investigate and resolve the issue.

22. Limitation of Liability

ClassTutor is not liable for:

  • poor internet connection or equipment issues on the student’s side;
  • missed lessons caused by student absence;
  • lack of progress caused by non-attendance, lack of effort or incomplete homework;
  • exam results, school decisions or third-party actions.

Nothing in these terms limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, breach of statutory rights, or any liability that cannot legally be excluded.

23. Changes to These Terms

ClassTutor may update these terms where reasonably necessary, including for legal, operational, safeguarding, payment or service-related reasons.

Where changes materially affect the parent/guardian’s rights or obligations, ClassTutor will provide reasonable notice.

24. Governing Law

This agreement is governed by the laws of England and Wales.

The courts of England and Wales will have jurisdiction over disputes arising from this agreement.

25. Acceptance of Terms

These Terms of Service are accepted electronically.

By making payment through a Stripe payment link, setting up automatic payment, or allowing the student to attend lessons, the parent/guardian confirms that they have read, understood and agree to these Terms of Service.

The parent/guardian agrees that electronic acceptance has the same effect as signing a written agreement.

ClassTutor may keep records of payment, enrolment, communication, lesson attendance and account activity as evidence that these terms were accepted.
